Terms and Conditions

1. General

The general terms and conditions apply to every offer, treatment and transaction between Beauty Massage Amsterdam and the client to which Beauty Massage Amsterdam has declared these terms and conditions applicable, insofar as the parties have not deviated from these terms and conditions explicitly and in writing.

2. Beauty salon efforts

  1. The beautician of Beauty Massage Amsterdam will perform the treatments to the best of her knowledge and ability and in accordance with the requirements of good workmanship.
  2. The client ensures that all information that may reasonably be important for the proper execution of the treatment is communicated to the beautician in a timely manner.
  3. The beautician of Beauty Massage Amsterdam is not liable for damage, of whatever nature, caused by the client relying on incorrect and / or incomplete information provided by the client.
  4. The beautician of Beauty Massage Amsterdam will inform the client about the financial consequences of the change of the treatment.

3. Appointments

  1. The client must report an absence from an appointment to Beauty Massage Amsterdam as soon as possible, but no later than twenty-four hours prior to the appointment.
  2. If the client does not or not timely fulfill this obligation, Beauty Massage Amsterdam may charge the entire fee for the agreed treatment to the client.
  3. If the client arrives at the salon more than five minutes later than the agreed time, the beautician may shorten the time lost on the treatment and still charge the entire fee for the treatment to the client.
  4. If the client arrives at the salon more than fifteen minutes later than the agreed time, the beautician may cancel the entire appointment and still charge the entire fee for the treatment to the client.
  5. Beauty Massage Amsterdam must report to the client for an appointment as soon as possible, but no later than twenty-four hours prior to the appointment.
  6. Both parties do not have to comply with the obligations of article 3a to 3f, if they are hindered by force majeure. Force majeure includes what the law and case law says about it.

4. Personal data & privacy

  1. Before / during the first treatment, the client provides the beautician with all information, which the beautician indicates are necessary or of which the client should reasonably understand that these are necessary for the careful execution of the treatments.
  2. The beautician takes the personal data of the client and processes it on a customer card which is then processed in a customer file.
  3. The beauty salon handles the confidential data of the client according to the guidelines in the Personal Data Protection Act.
  4. The beauty salon will not sell or rent client information to third parties without prior written permission from the client.
  5. The beautician is obliged to maintain the confidentiality of all confidential information communicated by the client during the treatment.
  6. Information is considered confidential if this has been told by the client or if this arises from the nature of the information.
  7. The confidentiality lapses if, on the basis of a statutory provision or a court decision, the beautician is obliged to provide the confidential information to third parties.

5. Payment

  1. Beauty Massage Amsterdam states all prices of the treatments and products visible in the salon.
  2. The stated prices include 21% VAT.
  3. Offers in advertisements are valid for the specified duration and / or while stocks last.
  4. Immediately after the treatment, the client must pay the payment for the treatment and any products by pin.

6. Liability

  1. Beauty Massage Amsterdam is not liable for damage of any kind caused by the beauty specialist of Beauty Massage Amsterdam based on incorrect and / or incomplete information provided by the client about physical disorders, use of medication, activities, leisure activities.
  2. Beauty Massage Amsterdam is not liable for loss, theft or damage to personal belongings that the client has brought to the salon.

7. Complaints

  1. If the client has a complaint about the treatment or a product, the complaint must be reported verbally and in writing to the owner of Beauty Massage Amsterdam as soon as possible, but within two weeks after discovery.
  2. Beauty Massage Amsterdam must provide the complainant with an adequate answer within 5 working days.
  3. If a complaint about the treatments is justified, Beauty Massage Amsterdam will perform the treatment again as agreed, unless this has become demonstrably pointless for the client and the client makes this known in writing.
  4. If a complaint about the products is justified, Beauty Massage Amsterdam partially or fully reimburse the purchase price of the products.
  5. If Beauty Massage Amsterdam and the complainant cannot reach an agreement, the complainant can submit the dispute to the legislator or mediator.

8. Warranty

  1. Beauty Massage Amsterdam gives the client a week (7 days) guarantee on the treatment and products.
  2. This warranty will lapse if:
    1. The client has been informed by the beautician about the result of the treatment and the duration of the effect of the treatment or products;
    2. The client has used products other than those recommended by the beautician;
    3. The client has not followed the advice for home care;
    4. The client has not followed the advice to seek medical attention within five working days;
    5. The client has not used the products according to the beautician’s advice;
    6. The client has not used the products in accordance with the instructions for use.
    7. The skin may react after a treatment. The client is informed of this during the treatment.

9. Specialization

  1. Depending on your health insurer and the policy conditions, a number of treatments are fully or partially reimbursed by them.
  2. The client pays the entire fee for the treatment to the beautician of Beauty Massage Amsterdam.
  3. The beautician of Beauty Massage Amsterdam provides an invoice with the correct information for the health insurer.
  4. The client is responsible for submitting the claim to the health insurer.
  5. The client must take into account the deductible amount of their health insurer.
  6. Beauty Massage Amsterdam is in no way responsible for further processing the claim to the health insurer.

10. Web shop

  1. The general terms and conditions for the web shop apply to product sales through the Beauty Massage Amsterdam web shop.
  2. Where these general terms and conditions deviate from the general terms and conditions of the web store, the general terms and conditions of the web store are leading.

11. Gift card

  1. The gift voucher cannot be exchanged for cash.
  2. The gift voucher can be redeemed up to one year after issue.

12. Damage and / or theft

  1. Beauty Massage Amsterdam has the right to claim compensation from the client if the client damages furniture, equipment or products.
  2. Beauty Massage Amsterdam always reports theft to the police.

13. Good behavior

  1. The client should behave in the salon according to generally accepted standards.
  2. If the client continues to display improper behavior after repeated warnings, the beautician of Beauty Massage Amsterdam has the right to refuse the client access to the salon without further stating reasons.
  3. Beauty Massage Amsterdam works according to the hygiene rules of the HAM code of beauticians.
  4. The client is expected to adhere to the personal hygiene rules.

14. Law

  1. Dutch law applies to every agreement between Beauty Massage Amsterdam and the client.
  2. The general terms and conditions are published on the Beauty Massage Amsterdam website and are also available in the salon.
  3. In the event of an explanation of the content and scope of the general terms and conditions, the Dutch text will always be decisive.
  4. The most recently published version or the version that applied at the time of the conclusion of the agreement is always applicable.

15. Confidentiality

  1. The beautician of Beauty Massage Amsterdam is obliged to maintain confidentiality of all confidential information that the client has communicated during the treatment.
  2. Information is considered confidential if this has been told by the client or if this arises from the nature of the information.
  3. The confidentiality lapses if, on the basis of a statutory provision or a court decision, the beautician is obliged to provide the confidential information to third parties.
